What is a 1031 exchange?
A 1031 exchange is one of the most popular tax strategies for investment real estate owners, allowing them to defer certain taxes on the gains realized when they sell one investment property and buy another.
What are the requirements and rules for a 1031 exchange?
There are specific rules and regulations that real estate investors should follow to conduct a valid 1031 exchange. For example, you need to use a Qualified Intermediary such as Accruit, buy and sell a “like-kind” property, identify your new property in 45 days, and complete the exchange in 180 days.
What kinds of real estate properties qualify for a 1031 exchange?
Nearly all real estate is “like-kind” to other real estate. Qualifying real estate can include single-family rental properties, commercial buildings, vacant land, easements, oil & gas, mineral, and water rights, DSTs, and more. Qualifying real estate can be exchanged for other qualifying real estate. For example, a commercial building can be exchanged for vacant land. Vacation homes may also qualify for a 1031 exchange if certain criteria are met. The main factor is the property must be held for investment or business use.
